DP RUTO;AM TAKING LEGAL ACTIONS AGAINST YOU JIRONGO

Deputy President William Ruto has threatened to take legal action against former Lugari MP Cyrus Jirongo for remarks he made during the requiem mass of slain Nairobi businessman Jacob Juma.
During the mass, Mr Jirongo and Kakamega Senator Boni Khalwale made remarks critical of the DP. Cord co-principals Raila Odinga, Kalonzo Musyoka and Moses Wetangula claimed that Juma’s death was orchestrated by the State as he was whistleblower on various scandals.
Now, Mr Ruto’s legal team say they are studying the comments.
Here is the full statement sent to newsrooms by Korir Sing’Oei, Ruto’s Legal Advisor:
The Deputy President has noted with concern the comments attributed particularly to Mr Cyrus Jirongo made today, Thursday the 12^th May 2016 during the memorial service of the late Jacob Juma.
Mr Jirongo made two statements of concern: First, he stated that the killers of Meshack Yebei, a prospective defence witness at the just concluded trial of the Deputy President at the International Criminal Court, were the same persons who killed Jacob Juma.

Second, he stated, “Juma slapped Ruto. That’s is where the problem started and investigations should start there.” Taken together, Hon Jirongo’s statements carry the patent insinuation that Mr Ruto was involved in the deaths of both Mr Yebei and Mr Juma.
Such a claim against the Deputy President would not only be false, unfounded, malicious, mischievous and without basis in fact, but also serves to malign and besmirch the character of the Deputy President and lower the reputation of his person and office in the most defamatory and unjustified fashion.
His Excellency William Ruto is further categorical that he never had any physical contact with the late Jacob Juma and the allegation that the deceased slapped him could therefore never have arisen.
We are reviewing the full transcripts of the reckless, malicious and defamatory statements made at the memorial of the late Juma by Mr Jirongo and others.
Given the potentially defamatory character of the narrative aforesaid, it follows that parties that perpetuate the dissemination, publication or circulation of this narrative will not escape legal culpability.

The Independent Electoral and Boundaries Commission (IEBC) lost its trust with a majority of Kenyans and is facing integrity crisis; corruption, scandal, and Voter registration. Which begs the question on its commitment to fulfill its constitutional mandate of conducting a flawless, free and credible elections next year.
The sustained calls and campaign by CORD coalition for commissioners to leave office is not founded on flippant allegations but realities on ground shared by most Kenyans.

In 2012 the lack of impartiality of IEBC commissioners was exposed in the registration of voters for the last general election, the IEBC distributed BVR machines unequally so that some regions of Kenya got a chance to register more voters than other areas.
The result of the registration exercise conducted by the IEBC in 2012 is the infamous “tyranny of numbers”. It was not that Jubilee areas did a better job pushing people to register. It was that the IEBC made it easier for people in those zones to register through skewed distribution of registration kits.
Free, fair and regular elections are enduring foundations of every democratic state, not just as episodic events, but as an integral part and societal infrastructure of civilized nations.
Kenyans note with concern the silence, secrecy, denial and general incompetence surrounding the IEBC three years after the last election in which all the equipment failed within the first hour of the opening of the polls.
Three years after an election characterised by missing Forms 34s and ever shifting numbers in the register of voters, virtually nothing is going on.
The BVR equipment failed in 2012, Kenyans have not been assured of any tests done to ascertain the kits can be used in 2017, and where they have been kept is a mystery.
The ground is being laid for another last-minute dash that paves the way for monumental corruption and, eventually, national grand failure.
Three years after the failure, Kenyans do not know anything that the IEBC is doing to ensure all citizens of voting age are registered or to get elections, including transmission of results.
Kenya has a population of more than 40 million people, but IEBC in has only registered 14 million people or 34 per cent as voters, a substantial number of potential voters left out.
The government and the IEBC are arguing against calls for reforms whose aim is to mend the democratic process, and ensure that the results of elections accurately reflect the will of the voters.
We cannot sit back and wait for a miracle.
IEBC bosses, led by their Chairman, Issack Hassan, and Chief Executive Officer, Ezra Chiloba are still in office on borrowed time. The patients of Kenyans has been stretched to the limits by the continued stay in office by the Commissioners.

Kuria's letter to the CJ WILLY MUTUNGA on CORD DEMONSTRATION AGAINST IEBC

An open letter to Chief Justice Willy Mutunga.
 In 1992 when the University of Nairobi wanted to expel me for carrying out my mandate as the duly elected Treasurer of the Students Organisation of Nairobi University (SONU), three people came to my rescue. Prof Kivutha Kibwana was my mentor-advisor. He lost his deanship at the School of Law courtesy to that case. My soulmate the late Otieno Kajwang sought and got an injuction against my expulsion at the High Court. Justice John Mwera gave the orders at 6pm! At the University tribunal, the best and finest lawyer i could get stopped the evil designs of the university at its tracks. That lawyer was none other than your dustinguished self, Willy Munyoki Mutunga. You taught me to respect and obey the law. Today I am proud to have you as the Chief Justice of the Republic of Kenya. Now, wakili wangu, I have a small matter. I have orders from Justice Lenaola stopping Raila Odinga and CORD from storming IEBC offices. CORD has not only defied summons by the court but they have also vowed to ignore the court ruling. Now, wakili wangu, mwalumu wangu, what should i do? Teach me once more. I have myself two criminal cases in the courts. Should i also defy the courts? Should i fail to appear? Should i term your courts 'bandia' as Raila and CORD do all the time? Should i be the only one to obey the court orders, rulings etc ? Forget your role as the CJ. If i were to retain you as my counsel like I did 24 years ago, what would yoy advise me to do? Obey or defy the law and orders from the court?

Raila Names the Killed ICC witnesses

Raila took the chance during the mass of late Jacob Juma at all saints cathedral  by Taking a dig at Uhuru and Ruto.  In his speech , raila slammed the government fot rampant assassination and took the opportunity to name the ICC witnesses Killed in order to eliminate evidence.

“There is a system, a way of life and a philosophy in this country that believes in murders; that produces murderers in Kenya; that believes, wrongly, in extra-judicial killings. In the aftermath of the Post-Election Violence, a chain of witnesses were systematically eliminated through extra-judicial killings,” he stated.
According to the Opposition leader, witnesses who were eliminated include:
